The Financial Conduct Authority (FCA) refused the request under section 36(2)(c) – prejudice to the conduct of public affairs and 36(2)(b)(i) - would or would be likely to inhibit the free and frank provision of advice. The Commissioner is satisfied that section 36(2)(b)(i) is engaged and the public interest favours maintaining the exemption. The Commissioner does not require the public authority to take any action.
