The complainant has requested information from the Metropolitan Police Service (the “MPS”) about an incident in Salisbury on 4 March 2018. Having initially refused the two related requests in their entirety citing the exemption at section 30(1) (investigations and proceedings) of the FOIA, the MPS revised its position during the Commissioner’s investigation. In doing so, it refused to confirm or deny whether it holds some of the requested information, citing sections 30(3) (investigations and proceedings) and 40(5) (personal information) of the FOIA.

The Commissioner’s decision is that sections 30(1) and 30(3) of the FOIA are both engaged and that the balance of the public interest favours maintaining both exemptions. The Commissioner requires no steps to be taken as a result of this decision. Information Tribunal appeal EA/2019/0382 under appeal.
