Spelthorne Borough Council (the Council) ultimately refused to provide the requested information under the exception provided by regulation 12(5)(f) (the interests of the information provider) of the EIR. The Commissioner’s decision is that the Council failed to demonstrate that regulation 12(5)(f) is engaged. The Commissioner requires the Council to take the following step to ensure compliance with the legislation: disclose the requested information to the complainant.
