The complainant has requested to know whether Northamptonshire Police forced entry to a property that he owns. Northamptonshire Police said that it could not respond to the request because of the Data Protection Act 2018. The Commissioner’s decision is that, under section 40(5B)(a)(i) (personal information) of the FOIA, Northamptonshire Police was not obliged to confirm or deny whether it held the requested information. However, she found that because Northamptonshire Police failed to specify the exemption on which it was relying, it breached section 17(1)(b) of the FOIA.Â
