The complainant has requested information connected to a complaint he submitted to the Financial Ombudsman Service (FOS). FOS has withheld the information under section 40(2) of the FOIA (personal data) and section 41 (information provided in confidence) and considers that section 31(1)(c)(law enforcement) is also engaged. The complainant considers the withheld information should be released. The Commissioner’s decision is as follows: FOS is entitled to rely on section 40(2) and 41(1) to withhold the disputed information. The Commissioner does not require FOS to take any remedial steps.
