The complainant has requested information from the Council regarding a tragic incident which occurred at the Greenvale Hotel in Cookstown in March 2019.  The Council stated that it did not hold some of the requested information, and refused to disclose the remainder, citing sections 31 and 38 of the FOIA as a basis for non-disclosure.

  1. The Commissioner’s decision is that the Council has correctly applied section 31 to the withheld information. As this applies to the entirety of the withheld information, the Commissioner has not considered the Council’s application of section 38 of the FOIA.

3.     The Commissioner requires no steps to be taken.
