The General Medical Council (GMC) has withheld the information under section 40(2) of the FOIA as it considers it to be the personal data of third persons. The Commissioner’s decision is as follows: The GMC is entitled to withhold the information the complainant has requested under section 40(2) of the FOIA as it is the personal data of a third person and disclosing it would be unlawful. The Commissioner does not require the GMC to take any remedial steps. Information Tribunal appeal EA/2020/0335 appeal dismissed.
