The Governing Body of the University of Chichester variously relied upon section 21 (reasonably accessible), section 41 (actionable breach of confidence), section 43 (commercial interests) and 14 (vexatious) of the FOIA to refuse to provide information.
The Commissioner’s decision is that section 43(2) of the FOIA is engaged in respect of the withheld information and that the balance of the public interest favours maintaining the exemption. The Commissioner does not require further steps.
