The Commissioner’s decision is as follows: The FCA is entitled to neither confirm nor deny it holds the requested information under section 31(3) of the FOIA as to do so would be likely to prejudice the exercise of its functions. The public interest favours maintaining this exemption. The Commissioner does not require the FCA to take any remedial steps.
