The complainant has requested correspondence relating to a Tribunal hearing. The Information Commissioner originally denied holding the information, before refusing the request as vexatious. The Commissioner’s decision is that the ICO was entitled to rely on section 14(1) to refuse the request as vexatious. As the ICO failed to issue its refusal notice within 20 working days, it breached section 17(5) of the FOIA. The Commissioner does not require further steps.
