The complainant has submitted four requests for information about the expenses of Operation Kenova. PSNI refused to comply with the requests, citing section 12(1) (Cost of compliance exceeds the appropriate limit) of the FOIA. The Commissioner’s decision is that PSNI was not entitled to rely on section 12(1) to refuse to comply with the requests. The Commissioner has also determined that PSNI failed to comply with its obligations according to section 16 (advice and assistance) of the FOIA. The Commissioner requires PSNI to take the following steps: Issue a fresh response to the requests that does not rely upon section 12.
