The complainant has requested, from the Office of the Police and Crime Commissioner for West Mercia (the “OPCC”), information about its data sharing practices with a company called Sancus. The OPCC refused to provide the requested information citing the exemptions at sections 43(2) (Commercial interests) and 36(2)(c) (Prejudice to the effective conduct of public affairs) of FOIA. Although not cited, the Commissioner has also considered section 40(2) (Personal information) in respect of the names and email addresses of the parties concerned.
The Commissioner’s decision is that section 43 is not engaged and that section 36 is only partially engaged. He also finds that section 40 is only partially engaged. He requires the OPCC to disclose the information which the Commissioner has identified in a separate confidential annex.
