The Care Quality Commission refused to confirm or deny holding information within the scope of the request and relied on section 40(5B) of FOIA (third party personal data) in order to do so. The Commissioner’s decision is that the CQC is entitled to rely on section 40(5B) of FOIA to neither confirm nor deny that it holds any information relevant to the request. The Commissioner does not require further steps.
