The complainant requested information relating to the number of individuals charged in relation to fraud offences. West Midlands Police confirmed it held information but refused to provided it, citing sections 40(2) (personal information) and 31(1) (law enforcement) of FOIA. The Commissioner’s decision is that West Midlands Police is entitled to withhold this information in accordance with section 40(2) of FOIA.
