The Commissioner’s decision is that NHS England has correctly engaged section 36(2)(c) of FOIA, but that the public interest favours disclosure. The Commissioner requires NHS England to take the following steps to ensure compliance with the legislation: disclose an unredacted copy of the report to the complainant. NHS England may redact contact details and names of junior staff members.
