Rotherham Metropolitan Borough Council (“RMBC”) provided some information, but withheld the remainder citing section 40(1) and 40(2) of FOIA (third party personal data) in order to do so. The Commissioner’s decision is that RMBC has correctly relied upon section 40 of FOIA to withhold the information. The Commissioner does not require any steps.
