The complainant has requested information about guidance on elective home education. The Department for Education (DfE) withheld the information under sections 36(2)(b)(ii), 36(2)(c), 40(2) and 42(1) of FOIA. These exemptions concern prejudice to the effective conduct of public affairs, personal data and legal professional privilege respectively. The Commissioner’s decision is as follows: At the time of the request DfE correctly applied section 36(2)(b)(ii) of FOIA to the information it withheld and the public interest favoured maintaining the exemption. The Commissioner does not require DfE to take any corrective steps.
