The complainant has requested from the London Borough of Enfield (the Council) information relating to disputed council fees.
The Commissioner’s decision is that the Council should have relied on section 40(5B) of FOIA to refuse to confirm or deny whether any information was held and has applied this exemption himself proactively.
The Commissioner does not require the Council to take any steps as a result of this notice.
