The complainant requested information from the Ministry of Justice (‘the public authority’). The Commissioner’s decision is that the public authority is entitled to rely on section 40(2) of FOIA to withhold all of the requested information. The Commissioner does not require the public authority to take any steps.  First-tier Tribunal (General Regulatory Chamber) Information Rights appeal EA/2023/0182 no right of appeal.
