The complainant requested a specified report from Thanet District Council (the ‘Council’) by the Independent Monitoring Officer. The Council ultimately refused to provide the full report (a summary version having already been released on its website) citing section 40(2) of FOIA (the exemption for personal information). The Commissioner’s decision is that the Council was entitled to withhold the full report by virtue of section 40(2) of FOIA. No steps are required as a result of this notice.
