The complainant has requested copies of particular emails from the Home Office. The Home Office cited section 12(1) (Cost of compliance) of FOIA to refuse the request.
The Commissioner’s decision is that some of the request is for personal information and that the Home Office should have cited section 40(5B)(a)(i) (Personal information) to refuse to confirm or deny whether the information is held. In respect of the remainder, he finds that the Home Office properly relied on section 12(1) and that there was no breach of section 16 (Advice and assistance) of FOIA. No steps are required.
