The complainant requested information from the London Borough of Barnet (the “Council”) relating to legal advice sought from counsel by the Council in relation to the lawfulness of its practices in relation to the Care Act.
The Commissioner’s decision is that the Council is entitled to rely on section 42(1) (legal professional privilege) of the FOIA to withhold the requested information. Information Tribunal appeal EA/2023/0192 appeal dismissed.
