The Commissioner’s decision is that: The Council was entitled to rely on section 40(2) when refusing this request. The Council, on the balance of probabilities, does not hold any additional information within the scope of the request. The Council breached section 17 by failing to issue a refusal notice within 20 working days. The Council also breached section 10 by failing to respond to the request within 20 working days. The Commissioner does not require further steps.
