The complainant has requested information about settlement fails related to particular US entities. The Bank of England (“the Bank”) refused to confirm or deny whether it holds the requested information, citing section 44(2) (prohibitions on disclosure) of FOIA as its basis for doing so.
The Commissioner’s decision is that the Bank was entitled to rely on section 44(2) of FOIA.
The Commissioner does not require the Bank to take any further steps. Information Tribunal FTT EA/2023/0257 appeal dismissed.
