During the Commissioner’s investigation, the Council provided a new response to the complainant, stating some information was withheld under Regulation 12(4)(e) (internal communications) of the EIR. The Commissioner’s decision is that the Council is entitled to rely on Regulation 12(4)(e) of the EIR to withhold the requested information. The Commissioner does not require further steps.
