The complainant has requested information from the Council regarding correspondence with various charities. The Council disclosed some information to the complainant, however the complaint is that it has not disclosed all information it holds within the scope of the request.
The Commissioner’s decision is that the Council has failed to fully consider all the information specified in the complainant’s request, therefore it has not complied with the requirements of section 1 of FOIA.
The Commissioner requires the Council to take the following steps to ensure compliance with the legislation:
• Issue a fresh response to the complainant disclosing all information it holds within the scope of the complainant’ request.
The Council must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of FOIA and may be dealt with as a contempt of court.
