South Hams District Council (the Council) provided some information and stated that other information was not held. The Commissioner’s decision is that the request falls under the EIR, but that regulation 5(3) of the EIR applies as the information is the complainant’s own personal data. This means that the Council was not obliged to comply with the request. The Commissioner does not require any steps.
