The complainant requested the name of a Court Clerk who had presided over a specified hearing. The Ministry of Justice refused to disclose the name of the now former clerk, citing section 40(2) (personal information) of FOIA. The Commissioner’s decision is that the MOJ was entitled to apply section 40(2) to refuse the request. The Commissioner requires no steps as a result of this notice.
