The Home Office provided some of the requested information, with redactions applied, citing sections 21 (information accessible to applicant by other means), 44(1)(a) (prohibitions on disclosure) and 38(1)(health and safety) of FOIA to withhold the remaining information. The Commissioner considered the Home Office’s application of sections 44(1) and 38(1). The Commissioner’s decision is that the Home Office is entitled to rely on sections 44(1) and 38(1) of FOIA to withhold the information.
