The complainant has requested from the General Dental Council (GDC)
information about ‘points of learning’ relating to a fitness to practice (FTP) case.
The GDC answered some of the questions asked and withheld some information,
citing section 42 of the FOIA (legal professional privilege). The Commissioner’s
decision is that the GDC is entitled to rely on section 42 to withhold the
requested information. The Commissioner does not require the GDC to take any
steps.
