The complainant requested information from Worcester City Council (the Council) relating to ‘green space’. The Council’s position is that it does not hold the requested information.
The Commissioner’s decision is that, on the balance of probabilities, the Council does not hold the requested information. It was therefore correct to apply regulation 12(4)(a) of the EIR. However, the Commissioner has also decided that the council failed to carry out an internal review within the statutory time limit and, therefore, it failed to comply with regulation 11(4) of the EIR.
The Commissioner does not require the Council to take any steps as a result of this decision notice.
