The complainant has requested information from City of Bradford Metropolitan District Council (“the Council”) relating to direct care payments. The Council provided the complainant with the information requested in parts 1, 3 and 4 of the request but refused to provide the information requested in part 2 of the request citing section 12(1) of FOIA as its basis for doing so.
The Commissioner’s decision is that the Council is entitled to rely on section 12(1) (cost limit) to refuse to provide the information requested in part 2 of the request. He also finds that the Council met its obligations under section 16(1) of FOIA to offer advice and assistance.
The Commissioner does not require the Council to take any steps. Information Tribunal EA/2023/0481 under appeal.
