The complainant has requested from The National Archives ‘closed’ information relating to the Elgin Marbles. TNA refused to provide this information, citing section 40(2)(personal information) and section 41(1)(information provided in confidence) of FOIA. The Commissioner’s decision is that TNA has correctly withheld the requested information under section 40(2) and 41(1) of FOIA. However, TNA breached section 17(1) of FOIA by providing its refusal notice late. The Commissioner does not require further steps.
