The complainant has requested information from the Home Office relating to a contract to deliver a project for the Home Office. The Home Office stated that it did not hold some of the requested information and it refused to disclose the remaining information (“the withheld information”) citing section 43(2) of FOIA as a basis for non-disclosure.
The Commissioner’s decision is that the information is commercially sensitive and the Home Office is entitled to withhold it under section 43(2) of FOIA. The public interest favours maintaining the exemption.
The Commissioner does not require the Home Office to take any corrective steps.
