The complainant has requested information relating to the death of a named individual. Devon and Cornwall Police (DCP) refused to provide the information citing section 30(1) of FOIA (Investigations and proceedings) and section 40(5) of FOIA (Personal data) as its basis for doing so. The Commissioner’s decision is that DCP was entitled to rely on section 30(1) of FOIA to refuse the request. No steps are required.
