The complainant has requested information relating to exposure to hydrogen sulphide (H2S). Newcastle Under Lyme Borough Council (the Council) refused the request, citing regulation 12(4)(b) of the EIR (manifestly unreasonable) as its basis for doing so, on the grounds that to comply with the request would incur an unreasonable burden on its resources.
The Commissioner’s decision is that the Council was entitled to rely on regulation 12(4)(b) to refuse the request.
The Commissioner does not require further steps.
