The complainant requested from the Home Office information concerning impact assessments for the Nationality and Borders Act 2022. The Home Office confirmed that some of the information requested is either already published or will be published online at a future date, and cited section 22(1) (information intended for future publication) of FOIA.
The Commissioner’s decision is that the Home Office was entitled to rely on section 22(1) of FOIA to withhold the information. Therefore, the Commissioner does not require the Home Office to take any further steps as a result of this decision.
