The complainant requested information from Devon County Council (“the Council”) regarding a public footpath, specifically confirmation of whether the landowners bore a consultation fee for a diversion proposal and a copy of a form sent to the landowners regarding an obstruction. The Council has withheld the information on the grounds that it is personal data under regulation 13 of the EIR.
The Commissioner’s decision is that the Council is entitled to rely on regulation 13 of the EIR to withhold the requested information.
