The complainant made a request for information relating to a variable speed limit in a certain area of the M25 motorway. National Highways has confirmed that it does not hold the information requested under section 1(1)(a) of FOIA.
The Commissioner considers that National Highways was correct to confirm that it does not hold the requested information. However, the Commissioner also considers that National Highways breached section 1(1)(a) of FOIA as it did not inform the complainant within 20 working days of the request that it did not hold the requested information.
The Commissioner requires no steps to be taken.
