The complainant has requested information relating to the occupation of the ‘Techboard Factory’. Blaenau Gwent County Borough Council (the council”) refused to confirm or deny (NCND) the requested information was held, under section 41(2) FOIA (information provided in confidence) and section 31(d) and 31(3) (law enforcement). The Commissioner’s decision is that the council is entitled to rely on section 31(3) FOIA to NCND whether any information is held and that the public interest favours maintaining the exemption.
