The complainant requested from the Department for Transport (DfT) a copy of an Equality impact Assessment related to proposed redeployment of former ticket office staff. The DfT refused to provide the information citing section 35(1)(a) (formulation and development of government policy) of FOIA.
The Commissioner’s decision is that the DfT has correctly relied on section 35(1)(a) FOIA.
The Commissioner’s decision is also that the DfT has not complied with sections 1(1)(a) and 10(1) of FOIA as it did not provide a response to the complainant’s request within 20 working days.
The Commissioner does not require any steps.
