- Decision(s) FOI 10(1): Upheld, FOI 31(1): Not upheld
The complainant has requested information about the “Right Care Right Person” model from the Metropolitan Police Service (the “MPS”). The MPS refused to disclose this information citing sections 31(1)(a) and (b) (Law enforcement) and 40(2) (Personal information) of FOIA.
The Commissioner’s decision is that the MPS was entitled to rely on sections 31(1)(a) and (b) of FOIA to withhold the requested information. However, in responding late to the request, it breached section 10(1) (Time for compliance) of FOIA. No steps are required.
