The complainant requested information relating to the department’s response to a historic settlement involving the complainant and the British Coal Corporation. DESNZ relied on FOIA section 12– cost of compliance, to refuse the request. The Commissioner’s decision is that DESNZ is entitled to refuse the request in reliance on FOIA section 12(2). The Commissioner does not require the public authority to take any steps to ensure compliance with the legislation.
