The complainant submitted a request to the London Borough of Merton (the council) for a cabinet paper in relation to a named car park.
The Commissioner’s decision is that the council correctly relied upon regulation 12(5)(d) (confidentiality of proceedings) to withhold the requested information, and that the public interest favoured maintaining the exception. However, in failing to issue a proper refusal notice, within 20 working days, the council breached regulation 14(3) of the EIR.
