The complainant has requested an audio recording of an interview which Surrey Police conducted with Jimmy Savile in 2009. Surrey Police refused to disclose the audio recording, citing section 38(1) (Health and safety) and section 40(2) (Personal information) of FOIA. The Commissioner’s decision is that Surrey Police was entitled to rely on section 38(1) and section 40(2) to withhold the requested information.
