It also confirmed to the complainant that it did not hold any further information falling within the scope of the request. The Commissioner’s decision is that the Council was entitled to withhold the name and email address of an Ofsted staff member under section 40(2) of FOIA. He finds that, on the balance of probabilities, the Council does not hold any further information falling within the scope of the request. The Commissioner does not require further steps as a result of this decision.
