The complainant requested information from Northumberland County Council (“the Council”) relating to a planning application. The Commissioner’s decision is that the Council is entitled to rely on regulation 12(4)(b) (manifestly unreasonable) to withhold the information requested in parts 1 and 3 of the request. He also finds that the Council complied with its obligations under regulation 9 of the EIR to offer advice and assistance. The Commissioner does not require the Council to take any steps.
