The complainant requested information held by Oxford Direct Services Limited (ODSL) about investigations carried out within a certain time period that related to undeclared gratuities accepted by employees. ODSL provided the complainant with information in response to part of their request, but withheld the remaining information under section 40(2) (third party personal information) of FOIA. The Commissioner’s decision is that ODSL is entitled to rely on section 40(2) of FOIA as its basis for withholding the remaining information that is relevant to the request.
