The Commissioner’s decision is that Warwickshire Police is entitled to rely on section 40(5) of FOIA to refuse to confirm or deny whether it holds the information requested.
However, the Commissioner has recorded a procedural breach of section 17(1)(a) of FOIA as Warwickshire Police failed to respond to the complainant’s request within the statutory time limits.
The Commissioner does not require any steps to be taken as a result of this decision.
