The complainant has requested information relating to a government statement on the financial incentivisation of biomass electricity generators. DESNZ refused the request in reliance on the exception at EIR regulation 12(5)(e) – confidentiality of commercial information.
The Commissioner’s decision is that in the circumstances of this case DESNZ correctly applied the exception at regulation 12(5)(e) and the public interest favours maintaining the exception.
The Commissioner does not require further steps.
